Best for you Human Rights Minister Natalius Pigai made a clarification regarding the proposal to suspend the detention of seven suspects who damaged a retreat house in Tangkil Village, Cidahu District, Sukabumi Regency, West Java.
It is known that the proposal was submitted by Pigai's special staff (stafsus), Thomas Harming Suwarta, on Thursday (3/7/2025) and caused criticism from various parties.
As for Pigai, he emphasized that this was not his proposal but a spontaneous statement from Suwarta.
He revealed that the proposal would not be followed up by him. Pigai said that if the proposal were implemented, it would be equivalent to the victim not receiving justice.
"As the Minister of Human Rights of Indonesia, I will not follow up on the spontaneous proposal from Thomas S Swarta, Special Staff of the Minister of Human Rights, because it undermines justice for the victims," he said, quoted from his tweet on his X account on Sunday (7/6/2025).
"Actions that violate the law are acts of individuals or personal actions conflicting with Pancasila," he continued.
Pigai emphasized that his party has not yet issued an official statement regarding this matter because it is still waiting for a report from the West Java Regional Office of the Ministry of Human Rights (Kanwik Kemenham).
"Until now, we have not issued a letter or official statement from the Ministry because we are waiting for the report from the West Java Regional Office," he said.
Previously, Suwarta stated that the proposal submitted relates to the postponement of detention of the suspects named Kemenham.
"The Ministry of Human Rights indeed encourages the suspension of detention for the suspect. As Mr. Kapolres said earlier, there are efforts to enforce the law in a professional, proportional, and just manner," he said.
Suwarta even said that the Ministry of Law and Human Rights will guarantee that the seven suspects can have their detention postponed.
She emphasized that the effort to seek justice can be done in various ways, such as mediation and restorative justice.
After his statement, Suwarta also said that the proposal would be submitted to the police in an official statement.
"So, seeking justice involves many efforts and methods, including the one who asked about restorative justice, where mediation efforts are carried out, and we are ready from the Ministry of Human Rights to ensure that our seven suspects are granted bail. We will issue an official statement to the police," he emphasized.
Proposed Restorative Justice
However, on Saturday (7/5/2025), Suwarta emphasized that his proposal has not yet become an official step from the Ministry of Human Rights.
He admitted that the proposal was made after he and his team conducted field research.
"This is just a proposal, I am only giving input after myself and the team have observed and found the dynamics on the ground. To date, there have been no official steps or letters from the relevant ministry regarding this proposal," said Suwarta.
Suwarta acknowledged the existence of intolerant actions that could potentially disrupt stability and tolerance in Tangkil Village regarding the incident of the destruction of the retirement house belonging to elderly woman Maria Veronica Ninna (70).
Unlike Pigai, Suwarta claimed to represent the Ministry of Human Rights by proposing a restorative justice solution to create peace.
We argue and propose that the best way to take is the path of reconciliation and peace through restorative justice "which of course must be carried out in accordance with the applicable regulations," said Thomas.
This solution, according to him, is part of the joint commitment to always maintain regional stability and national integration.
She added that the Human Rights Ministry strongly supports the law enforcement process carried out against the perpetrators of the villa destruction in Sukabumi, while still keeping in mind Article 28 I paragraph (4) of the 1945 Constitution of the Republic of Indonesia, Jo. Article 8 Jo. Article 71 of Law Number 39 of 1999 on Human Rights, which states " Every citizen has the right to receive protection, respect, and fulfillment of human rights that are the responsibility of the state.
"Which is also no less important is the common will of us as a diverse nation, that managing this complex diversity and religious freedom in Indonesia certainly requires wisdom and prudence," Thomas concluded.
