Contrary to Susno Duadji
As the special investigation into the case of the diploma of President of the Republic of Indonesia, Joko Widodo (Jokowi), is set to be held by Bareskrim Polri on Wednesday (7/9/2025), former Bareskrim Chief Komjen (Ret.) Susno Duadji gave an interesting legal opinion that attracted attention.
According to Susno, the possibility of designating Rismon Sianipar and others as suspects in this case is very low, especially if related to the alleged defamation case currently handled by Polda Metro Jaya.
"If the object itself (diploma) has not been proven to be genuine, how can it be considered as defaming one's reputation? If it is only said to be identical, that is not sufficient to implicate Rismon and others," said Susno in a TVOne broadcast on Friday (7/4/2025).
Susno considers the determination of the authenticity of the diploma as a crucial point in this legal process.
According to him, the term "identical" previously mentioned by the police was not strong enough as a legal basis without a clear comparison.
"Which one is it identical to? If it's identical to a fake document, then it's still fake. There must be an official institution that declares the original document as the reference," he emphasized.
That is why, he recommended that all investigations be transferred to the Bareskrim of the Police so that the legal resolution is more coordinated and to avoid public misinterpretation.
Although he referred to the special case as a common matter, Susno considered this case to be highlighted because it involves a national figure and the object of examination is the President's diploma.
She also asked the investigators to be careful, because the two parties that have reported each other, namely Jokowi and TPUA, are still within the scope of the investigation.
"Handling of the reporter should be equal, because the process is still the same investigation," he said.
Responding to Susno's statement, President Jokowi's lawyer, Rivai Kusumanegara, stated that the case title is part of the usual procedure. However, he emphasized that the process must be purely initiated by the investigators, not due to pressure from certain parties.
" Investigators must be neutral, there should be no intervention, including from TPUA," said Rivai.
Rivai explained that the report submitted by Jokowi's side not only contains the article on defamation, but also includes elements of slander, information technology manipulation, and the use of personal data without permission.
Although the proof of the defamation allegations still depends on the authenticity of the degree, Rivai considers that the element of defamation can still be processed even if the document has not been proven to be fake.
"His speech is not about whether the content is correct or not, but the way it was delivered in public and aimed at discrediting," he explained.
Regarding the forensic laboratory (labfor) results previously conducted by Bareskrim, Rivai admitted that the results have not yet reached the stage of pro justitia because they are still in the investigation phase.
However, according to him, the investigators from Polda Metro Jaya can still conduct further laboratory tests as part of the legal process.
"All legal processes must be carried through to the end. They must not be opened without a clear resolution," he emphasized.
As information, the special case of Jokowi's diploma, which was previously scheduled for Thursday (3/7/2025), has been officially postponed by Bareskrim Polri. The agenda is now rescheduled for Wednesday (9/7/2025) next week.
